PROMOTION PERIOD: Commute with Enterprise $500 Gift E-Card Giveaway (the “Promotion”) begins on September 09, 2021, at 7:00 a.m. PT and ends on September 12, 2021, at 11:45 a.m. PT (“Promotion Period”). Sponsor’s computer is the official time-keeping device for this Promotion.

ELIGIBILITY: Promotion is open to 1) lawful residents of the 50 United States, including the District of Columbia 2) who are attending SHRM 2021 in Las Vegas, Nevada (the “Exposition”), and 3) are age 21+ at the time of entry.

You are ineligible to participate in the Promotion if you are not an attendee of the Exposition. Employees, officers and directors of Enterprise Holdings, Inc. (the “Sponsor”), and/or their respective parent companies, affiliates, subsidiaries, related companies, representatives, consultants, contractors, legal counsel, and advertising/promotional, public relations, fulfillment and marketing agencies that are involved in administering the Promotion (collectively, the “Promotion Entities”) and members of their immediate families (parents, spouse, children, siblings, grandparents, step parents, step children and step siblings) and members of their household (whether related or not) are not eligible to enter or win. Winning a prize is contingent upon fulfilling all requirements set forth herein.

Participation in the Promotion is voluntary. Participants must not allow their participation in the Promotion to interfere with their ability to complete assigned work or others’ ability to complete their assigned work, as determined by their management.

PLEASE NOTE: It is the entrant’s sole responsibility to review and understand his or her employer’s policies regarding eligibility to participate in trade promotions. If participation in this promotion is in violation of employer policies, the entrant may be disqualified from entering or receiving prizes. Sponsor disclaims any and all liability or responsibility for disputes arising between an employee and his or her employer related to this matter, and prizes will only be awarded in compliance with the employer’s policies. This is a trade promotion and is not open to the general public.

HERE’S HOW TO ENTER THE PROMOTION:
During SHRM 2021, September 9-12, up to 11:45 a.m. PT of the final day, attendees must scan their identity badges at the Enterprise Holdings booth #15033 (“Eligible Entry”). Attendees may earn one additional bonus Eligible Entry by presenting a printed copy of the “Bonus Entry” certificate, available on CommutewithEnterprise.com/SHRM.

Limit of one scanned entry and one Bonus Entry per person during the Promotion, but you must meet all eligibility requirements stated in these Official Rules. All eligible entries received during the Promotion Period will be entered in the random draw. All Promotion entries submitted become the sole property of Sponsor and will not be returned. Incomplete, illegible or untimely entries are void and will be disqualified.

PROMOTION DRAWING, ODDS and NOTIFICATION: Prize winners will be selected from all eligible entries received during the Promotion Period through random drawings after Exposition hours beginning at approximately 12 p.m. PT on September 12th, PDT by Sponsor, whose decisions are final and binding in all matters relating to this Promotion. Odds of winning a Prize depend on the number of eligible entries received during the Promotion Period. You do not have to be physically present at time of drawing to win, the e-gift card will be sent electronically via e-mail to the winner(s) recipients’ e-mail address provided in entry or registration. The eligible potential winners will be notified by e-mail or text only. If the e-mail address provided is invalid or illegible, it is forfeited. Sponsor reserves the right to randomly select an alternate eligible winner from among the remaining eligible entries. There is a limit of one prize per person and per household.

Verification of Potential Winners: ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROMOTION. PRIZES/APPROXIMATE RETAIL VALUES (ARV):
A total of two (2) prizes will be awarded as follows:

The Gift Cards are issued by third party issuer and Sponsor does not have any control over any fees, expiration dates, or similar restrictions imposed on such Gift Cards by the applicable issuer or for the applicable issuer’s compliance with applicable laws, including the Card Accountability, Responsibility, and Disclosure Act of 2009.

PRIZE CONDITIONS: Unless authorized by Sponsor, each Prize must be accepted as awarded. The Prizes
may not be transferred, substituted or redeemed for cash, except at Sponsor’s sole discretion, and Sponsor reserves the right to substitute the Prize or a component thereof with a prize of equal or greater monetary value whether cash or otherwise. If the actual value of a Prize is less than the stated ARV, the difference will not be awarded. Any depiction of a Prize is for illustrative purposes only. Sponsor will not replace any lost or stolen prizes or components of a prize(s). Sponsor agrees to abide by any corporate policy of a company with respect to the awarding of prizes to employees by suppliers, provided that Sponsor is informed in advance of that policy by company. Sponsor will not intervene in any decision made by a company that purports to prevent an employee from receiving the Prize, and Sponsor reserves the right to randomly select another eligible entrant if the selected entrant cannot accept the Prize offered for any reason. Prize winner is solely responsible for the reporting and payment of any income tax relating to the Prize, as well as any other applicable federal, state, and local taxes, fees and expenses related to acceptance and use of the Prize not specifically stated herein. The eligible winners must sign and return an Affidavit of Eligibility/Declaration of Compliance and Liability and Publicity Release (“Declaration and Release”) within five (5) days of prize notification and must still be employed with the collision center indicated on their official Entry Card. If such documents are not returned within that time, or if entrant is found to be ineligible, or if he/she does not comply with these Official Rules, then such eligible winner will be disqualified and, an alternate winner will be randomly selected in accordance with these Official Rules. If prize or prize notifications are returned as undeliverable, this will result in disqualification. Only the number of prizes stated in these Official Rules is available to be won in the Promotion. If, by reason of a print or other error, more prizes are claimed than the number set forth in these Official Rules, an alternate winner will be selected in accordance with the winner selection method described above from among all eligible claimants making purportedly valid claims to award the advertised number of prizes available. LIMITATIONS OF LIABILITY AND RELEASE: BY PARTICIPATING IN THIS PROMOTION, ENTRANTS AGREE TO RELEASE, HOLD HARMLESS AND INDEMNIFY SPONSOR, ITS PARENT AND SUBSIDIARY COMPANIES, AFFILIATES, DIVISIONS, FRANCHISEES, CONSULTANTS, SUB-CONTRACTORS, SUPPLIERS, DISTRIBUTORS, LEGAL COUNSEL, ADVERTISING, PROMOTION, FULFILLMENT, MARKETING AND PUBLIC RELATIONS AGENCIES, AND INDEPENDENT CONTRACTORS, AND THE RESPECTIVE SHAREHOLDERS, OFFICERS, DIRECTORS, MEMBERS, MANAGERS, EMPLOYEES, REPRESENTATIVES, OFFICERS, DIRECTORS, MEMBERS, MANAGERS, AND AGENTS OF EACH (COLLECTIVELY, "RELEASED PARTIES") FROM ANY LIABILITY WHATSOEVER FOR ANY CLAIMS, COSTS, INJURIES, LOSSES, LIABILITY, OR DAMAGES OF ANY KIND, INCLUDING LEGAL FEES, ARISING OUT OF PARTICIPATION IN THIS PROMOTION, WHILE PREPARING FOR, PARTICIPATING IN AND/OR TRAVELLING TO OR FROM ANY PRIZE- OR PROMOTION-RELATED ACTIVITY, OR DELIVERY, POSSESSION, AWARDING, MISDELIVERY, ACCEPTANCE, USE, MISUSE OR INABILITY TO USE OR REDEEM THE PRIZE (INCLUDING, WITHOUT LIMITATION, CLAIMS COSTS, INJURIES, LOSSES AND DAMAGES RELATED TO PERSONAL INJURIES, DEATH, LOSS, DAMAGE, ACCIDENT, OR DESTRUCTION TO OR OF PERSON OR PROPERTY, RIGHTS OF PUBLICITY OR PRIVACY, DEFAMATION OR PORTRAYAL IN A FALSE LIGHT, WHETHER INTENTIONAL OR UNINTENTIONAL). Released Parties are not responsible for any misprints, typographical or other error in these Official Rules, in any Promotion-related advertisements or other materials, or the printing, the offering or the announcement of any prize or in the administration of the Promotion. The Released Parties are not responsible for late, lost, damaged, misdirected, incomplete, illegible, stolen or destroyed Bonus Entries submitted to or by an Enterprise representative or through the postal service, or for technical failures or other errors or malfunctions of any kind whether human, mechanical, electronic, or otherwise. Proof of sending or submission of entry will not be deemed proof of receipt by Sponsor. The Released Parties are not responsible if any prize cannot be awarded due to cancellation of the of the trade show, acts of God, acts of war, natural disasters, weather, or terrorism. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

GENERAL: Sponsor may prohibit an entrant from participating in the Promotion, or from winning a Prize if, in its sole discretion, Sponsor determines that said entrant is attempting to undermine the legitimate operation of the Promotion by cheating, deception or other unfair playing practices, or intending to annoy, abuse, threaten or harass any other entrants or Sponsor’s representatives. Bonus Entries are void if not obtained through authorized, legitimate channels, or if any part is defective, altered, duplicated, photocopied, forged, counterfeited, mutilated or tampered with in any way.

By participating in this Promotion, participants agree to be bound by these Official Rules and by the decisions of the Sponsor, and further waive any right to claim ambiguity in this Promotion or these Official Rules. The Promotion Entities expressly disclaim any express or implied warranties in connection with the Prizes.

No correspondence will be entered into except with the eligible winners. Except where prohibited by law, accepting a Prize constitutes permission for the Promotion Entities (which permission will be confirmed in writing on request of Sponsor), and any of their designees, to print, publish, broadcast, and use winner’s name, portrait, picture, likeness, statements, biographical information, voice, and address (city/state) worldwide and in all forms of media now known or hereafter developed, including but not limited to the World Wide Web, in perpetuity, for advertising, trade, and promotional purposes, without further review, approval, notice or compensation.

If any factor interferes with conduct of this Promotion or any part of it as contemplated by these Official Rules or for any reason this Promotion or any part of it is not capable of running as planned including, but not limited to, tampering, unauthorized intervention, fraud, accident, printing, administrative, or other error of any kind or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, then Sponsor reserves the right, at any time, without notice or obligation and in its sole discretion, to (a) void any suspect entries; and/or (b) cancel, terminate, modify, suspend or amend this Promotion and these Official Rules in whole or in part, and/or (c) resume the Promotion in a manner that best conforms to the spirit of these Official Rules; and/or (d) award the prizes at random from among the eligible, non-suspect entries received up to the time of impairment.

PRIVACY: By entering this Promotion, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her entry for the purpose of administering the Promotion, to contact entrant with Sponsor’s sales information and in accordance with Sponsor’s privacy policy, which can be found at https://www.commutewithenterprise.com/en/privacy-policy.html.

GOVERNING LAW/DISPUTES: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the federal court in St. Louis, Missouri or the State Court in St. Louis County, Missouri; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Missouri, without giving effect to any choice of law or conflict of law rules (whether of the State of Missouri or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Missouri.
